pond basket patent claims

Exclamation pond basket patent claims

There is a “strainers” thread on other forum, which as usual turned into mush quickly. However, one importance reference buried in ton of junk caught my eyes, it is the possibility of using the pond basket as an air pruning container is infringing on VW’s patent.

I have found the patent and it is an excellent writing. It has two independent claims, (one for apparatus and one for method) and – holly patentito! – the claims do cover the pond basket like structures (with an addition requirement). The patent attorney must have been a very good one to push the claims thru.


Yes, folks, depending on what you are doing, it is possible that you are infringing on this patent.

The patent was filed in Apr 1992.

I am wondering what your purpose is with this post. This is your 14th post in how long on the forum? And this reads like an attempt to stir up trouble. For your 15th post, how about you add something substantive to the forum for a change? Perhaps show us a tree you are working on?

What the heck are you talking about? What does baskets, collenders or stainers have to do with volkswagens? I have a yard full of VW's and none of them have a basket on them. The closest thing to a basket is the fact that many are basket cases. I am with Chris on this one, let talk about bonsai, and if you want to talk about VW's meet me at thesamba.com.

Um, VW = Vance Wood the patent holder of the grow basket design in question. But I agree with Chris on this one, it seems like a distraction, but here I am replying...

I don't think you can infringe on somebody's patent unless you are directly profiting from a method of apparatus that is patented. Anybody can duplicate or use any method or apparatus that is patented at any time they wish, so long as they do not try to profit directly from it without paying royalties or etc. to the patent owner.. Good day.

Just for arguments sake I have thought about filing a law suit but the ods of winning anything worth the trouble to do it are small, especially if pond baskets are made over seas--you think they are not. Before you jump all over this (for what reason I cannot fathom) the next time you come up with some intelectual property of your own that you try to protect through the patent process remember-----

Sometimes a cigar is just a cigar, maybe he thought to just inform. For the life of me I cannot understand why you would jump all over this, what are you offended with here, its not a personal attack? It seems to me he started the thread and there are no rules about what a thread must be about. Is this about bonsai? Yea, I think so.
