Oqma, hi there. Two things you might want to do to allow us to help you. 1- take another picture of one or two leaves...with a plain background. It is a bit hard to see the leaves in the picture you attached. 2- Go back into your 'user cp' and then 'edit profile' and list your USDA growing zone and your town or county.. include the state. This way when someone gives you advise they will know where the tree is living.

From the picture I think that maybe it is a Ginkgo. I am not an expert on this (or any) tree. It does look a bit like one. And as I said a pix of the leaves would be a big help.....

thx for all the help Jay, ill post a new picture as soon as I get one, its a bit hard since my usb on my main computer is bugged for my digital camera or something so I have to use a filesharing program to transfer my stuff from another computer, Ill have a better picture coming up, this is just my opinion from looking at trees online, I dont think it is Ginkgo but that is what I guessed at this point also. Thx

At first glance it looked like Gingko because of the lobed leaves, but I think it may be Gooseberry (Ribes uva-crispa).

It's just a guess, but I remember seeing a Gooseberry in person a while back, and the leaves were somewhat similiar to a Gingko.

Got a picture of a single leaf? It's hard to tell from that angle...

the leaves actually do have a three way split like that, and to describe them further, the sides of the leaves have a little thornlike structure, little white points on the sides

It's still pretty hard to tell from that second photo, but I don't think it's a hawthorn. The leaves don't really look uniformly sized enough. It is definitely not a ginkgo. It almost looks like a tree peony from the top, but maybe not so much from the side.

A well-focused shot like the one from above would be helpful!
