Sad to say but some do. It is an easy way to get around a plant paten.
A good example of this is the " ficus princess marsha, ficus too little and the Brussels sprout.
All are the same plant from the same stock. Propagate it yourself, change the name and you are in business. Seems like there is always a way to beat the system.
