I am gonna say it is a Brush Cherry. I have one that is very similar to this. However mine does flower and fruit when the conditions are right. It didnt flower and fruit for a while tho. Here is a pic of the green stuff on my mother tree (for cuttings). I concidered three ideas that your tree might be....

one a boxwood of somesort...


a brush cherry pictured below.

orange jasmine, in the next post is a pic. box and brush cherry have similar bark textures, and all three have leaves similar to yours.
