It's still pretty hard to tell from that second photo, but I don't think it's a hawthorn. The leaves don't really look uniformly sized enough. It is definitely not a ginkgo. It almost looks like a tree peony from the top, but maybe not so much from the side.

A well-focused shot like the one from above would be helpful!
